By accessing or using the FPSWare.com website and purchasing any digital products or license keys (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and FPSWare ("we," "us," or "our").

2. Eligibility

You must be at least 18 years of age or the age of legal majority in your jurisdiction to use our Services. By using our Services, you represent and warrant that you meet the eligibility requirements. If you are using our Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Digital Products & License Keys

All products sold through FPSWare.com are digital goods delivered electronically. Upon successful payment, you will receive a license key or download link granting you a non-exclusive, non-transferable, revocable right to use the software in accordance with its specific license terms. You acknowledge that:

• License keys are for personal use only and may not be resold, redistributed, shared, or transferred to third parties.
• Each license is bound to a single user and/or device as specified in the product description.
• We reserve the right to revoke any license at our sole discretion if these Terms are violated.
• Digital products are delivered as-is at the time of purchase. Features may change with updates.

4. Account & Purchase Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials and license keys. Any activity that occurs under your account is your responsibility. You agree to immediately notify us of any unauthorized use. We are not liable for any loss arising from unauthorized access to your account.

5. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any product.
• Share, resell, sublicense, or distribute license keys or software to any third party.
• Use our products for any unlawful purpose or in violation of any applicable local, state, national, or international law.
• Attempt to circumvent any security measures, license verification, or access controls.
• Use automated systems (bots, scrapers, etc.) to interact with our Services without express permission.
• Engage in any activity that disrupts, damages, or impairs the functioning of our Services.

6. Payment & Pricing

All prices are displayed in USD unless otherwise stated. Payments are processed through our third-party payment processors (OVGC for card payments and OxaPay for cryptocurrency). By completing a purchase, you agree to the relevant payment processor's terms in addition to ours. We reserve the right to modify pricing at any time without prior notice. Price changes do not affect previously completed transactions.

7. Delivery

All digital products are delivered instantly upon successful payment confirmation. License keys and/or download links are provided via email and/or through your account dashboard. If you do not receive your product within a reasonable timeframe, contact our support team via Discord. Delivery delays caused by third-party payment processing are not within our control.

8. Intellectual Property

All content on FPSWare.com, including but not limited to text, graphics, logos, software, and digital products, is the intellectual property of FPSWare or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

9. Limitation of Liability

To the maximum extent permitted by law, FPSWare and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of our Services. Our total aggregate liability shall not exceed the amount you paid for the specific product giving rise to the claim.

10. Disclaimer of Warranties

Our Services and products are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our Services will be uninterrupted, error-free, or free of harmful components. You use our products at your own risk.

11. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Upon termination, your right to use our products and any associated licenses will immediately cease. Provisions that by their nature should survive termination shall remain in effect.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from or relating to these Terms or your use of our Services shall be resolved through binding arbitration or in the small claims court of competent jurisdiction, at the sole election of FPSWare. You agree to waive any right to a jury trial or to participate in a class action.

13. Modifications

We reserve the right to update or modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of our Services after any modification constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
